MILL CREEK - A DUI arrest has been made regarding the Jan. 19 wreck that resulted in two Randolph County Sheriff's deputies being injured.
James Brise Scott, 19, has been charged with DUI causing serious bodily injury. He is being held in the Tygart Valley Regional Jail on a $15,000 cash-only bond, set by Magistrate Ben Shepler.
According to the criminal complaint, prepared by Trooper N.R. Hall, of the Elkins Detachment of the West Virginia State Police, at about 4:10 a.m. Jan. 19, officers were dispatched to the area of U.S. Route 219 and Adolph Road to investigate a two-vehicle accident. Two deputies were responding to a call in Mill Creek on Taylor Lane and collided with a full-size Dodge truck, according to a Sheriff's Office press release.
Hall arrived on the scene and was told the driver of the truck, identified as Scott, "seemed to be intoxicated," the complaint states. While speaking with him, Hall noted that Scott had "blood shot and watery eyes."
Hall began administering standardized field sobriety tests to Scott, who "showed signs of impairment," according to the complaint. Scott also allegedly told Hall that he had consumed approximately six beers.
The complaint states that Scott's blood alcohol content level was .188. Scott was transported to Davis Medical Center for treatment, while three passengers in the vehicle were not injured, the press release states.
Deputy A.B. Beverly and Deputy B.M. Roy were also transported to DMC, according to the release. Deputy Beverly was treated and released, while Deputy Roy underwent surgery for a broken femur, and will be off work for several weeks.
If Scott is convicted of the charge, he could face from two to 10 years in prison, and and could be fined from $1,000 to $3,000.
